When you use our mobile applications and communication services, in addition to information described in our Terms of Use, such as your profile and contact information, we automatically collect certain information from your device including your precise geolocation, information about your device such as the device type, device ID, operating system, wireless service provider and information about the operation of our application and your usage of our application, including features you used, pages you viewed, and when and for how long you used the application. By using MedInfo mobile applications, you agree that MedInfo may collect this information and use, transmit, process, and store that information as described in MedInfos' Privacy Policy including to provide and improve our Services.

MedInfo does not make any representations or guaranty about whether the Services are adequate to meet your privacy and security compliance obligations under HIPAA or any other standards, laws, rules or regulations. You are responsible for assessing your privacy and security needs and determining whether your use of our Services is appropriate to comply with your obligations.

Equipment

When using the Services, information will be transmitted over a medium that may be beyond the control of MedInfo, our licensors or suppliers. Accordingly, neither MedInfo, its licensors nor suppliers assume liability for or relating to the delay, failure, interruption or corruption of any data or other information transmitted in connection with your use of the Services. You are responsible for obtaining and maintaining all connectivity, computer software, hardware and other equipment needed to access the Services and all charges related to the same.

Laws That Govern This Agreement

We control those components of the Services made available through our respective websites from our offices within the State of Colorado in the U.S. The Services are to be used only in the U.S. Since the laws of each state or country able to access the Services may differ, by accessing the Services, you agree that the statutes and laws of the State of Colorado, without regard to choice of laws principles, will apply to all matters relating to use of the Services. No waiver of any of these Terms of Use shall be deemed a further or continuing waiver of such terms or any other term. We make no representation that materials made available through the Services are appropriate or available for use in other locations, and accessing them from territories where their contents are illegal is prohibited. If you access the Services from outside the U.S., you are responsible for compliance with the laws of your jurisdiction.

Termination And Modification

You agree that we may, under certain circumstances and without prior notice, discontinue, temporarily or permanently, the Services (or any part thereof) or eliminate your account, any associated email address, and remove any information you uploaded or provided to the Services with or without notice. Cause for termination shall include, but not be limited to, (a) breaches or violations of these Terms of Use or other incorporated agreements or guidelines, (b) requests by law enforcement or other government agencies, (c) a request by you (self-initiated account deletions), (d) discontinuance or material modification to the Services (or any part thereof), (e) unexpected technical or security issues or problems, (f) extended periods of inactivity, and/or (g) your engagement in fraudulent or illegal activities. You agree that all terminations for cause shall be made at our sole discretion, and neither we nor our licensors shall be liable to you or any third party for any termination of your account, any associated email address, or access to the Services or any portion thereof.

Notice And Take Down Procedures And Copyright Agent

If you believe any materials accessible on or from the Services infringe your copyright or privacy, you may request removal of those materials (or access thereto) from the Services by contacting MedInfo at info@GetMyHospital.com and providing the following information: 

1. Identification of the copyrighted work or privacy issue that you believe should be removed. Please describe the work or privacy concern, and where possible include a copy or the location (e.g., URL).
2. Identification of the material that you believe to be infringing and its location. Please describe the material concern, and provide us with its URL or any other pertinent information that will allow us to locate the material. 
3. Your name, address, telephone number and (if available) e-mail address. 
4. A statement that you have a good faith belief that the complained of use of the materials is not authorized by the copyright owner, its agent, or the law. 
5. If you are concerned about a privacy issue, please forward us a statement detailing the concern and what you would like done with the material.
6. For copyright concern, a statement that the information that you have supplied is accurate, and indicating that "under penalty of perjury," you are the copyright owner or are authorized to act on the copyright owner's behalf. For privacy concern, a statement that the information that you have supplied is accurate, and indicating your credentials to verify the privacy concern.
7. A signature or the electronic equivalent from the copyright holder or authorized representative.

Additional Terms

Some of the Services implement the Google Maps web mapping service. Your use of Google Maps is subject to Google's terms of use, located at http://www.google.com/intl/en_us/help/terms_maps.html.

Complete Agreement

Except as expressly provided in a particular "legal notice" on the website, this Privacy Policy and the Terms of Use (found at http://getmyhospital.com/myHospital/terms) constitutes the entire agreement between you and MedInfo with respect to your use (and prior use) of the Services. If any provision of these Privacy Policy is deemed to be unenforceable as written by a court of competent jurisdiction, the parties intend that such provision shall be modified to the extent necessary to make the provision enforceable. If the provision cannot be modified in this manner to make it enforceable, the parties intend that the provision shall be removed and the remaining provisions shall remain in full force and effect.
